5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Freedom from computer virus or other harmful code

Agent99 Labs Inc. does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

6. Limitation of Liability

IN NO EVENT WILL AGENT99 LABS INC., ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

7. Changes to Terms

Agent99 Labs Inc. reserves the right to modify or replace these Terms at any time at its sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.

8. Refund Policy

Due to the nature of our Services and the immediate consumption of computing resources, Agent99 Labs Inc. does not offer refunds for any purchased services, credits, or subscriptions.

No Refund Policy Explanation

When you use our Services, we incur immediate and non-recoverable compute costs. These include but are not limited to:

  • Server processing time and computational resources
  • API usage and third-party service fees
  • Data storage and transfer costs
  • AI model inference and training expenses

Once these computing resources have been utilized, they cannot be returned or reused, which is why we cannot provide refunds for services already rendered.
